The petitioner seeks regular bail in connection with Hajipur Town P.S. Case No. 513 of 2019, registered for the offence punishable under Sections 399, 402, 414/34 of the Indian Penal Code and Sections 25(1-B)a, 26, 35 of the Arms Act.
The allegation is regarding the police having got secret information that the accused persons were planning to commit dacoity and thereafter, they had raided the place of occurrence and apprehended the accused persons including the petitioner herein. As far as the petitioner is concerned, one country made pistol and one live cartridge were recovered from his possession.
Patna High Court CR. MISC. No.60830 of 2019(5) dt.16-11-2019 2/2 The learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, he is having a clean antecedent and he is languishing in custody since 8.6.2019.
Having regarding to the facts and circumstances of the case, I deem it fit and proper to direct for release of the petitioner immediately upon completion of six months in custody i.e. with effect from 8.6.2019, upon such conditions as may be deemed fit and proper to be imposed by the learned court of C.J.M. Vaishali at Hajipur in connection with Hajipur Town P.S. Case No. 513 of 2019.
The present petition stands disposed of with the aforesaid directions.
