2. The petitioner seeks bail in connection with Bhore P.S. Case No. 64 of 2022 registered for the offence under Section 366 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have kidnapped the victim girl.

4. Learned counsel for the petitioner submits that the petitioner is innocent and he has falsely been implicated in this case. It has further been submitted by the learned counsel for the petitioner that the victim girl is a major and it has come during investigation that the she stayed with the petitioner for few days in Mumbai and after that she came to the her home where she stayed for one month and thereafter the police

Patna High Court CR. MISC. No.71608 of 2023(4) dt.29-02-2024 2/2 recovered her.

5. It is also submitted by the learned counsel for the petitioner that the petitioner is in jail since 25.07.2023.

6. Learned APP for the State vehemently opposed the prayer of the petitioner for grant of bail.

7. Considering the aforesaid facts, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-cum-Special Judge, POCSO, Gopalganj in connection with Bhore P.S. Case No. 64 of 2022.
