JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-09-2022 At the outset, the learned counsel for the petitioner has submitted that the amount quantified as the deficit stamp duty by the impugned order dated 10.1.2017, passed by the Assistant Inspector General Registration, Darbhanga Division, Darbhanga in Stamp Case No. 63/2016-2017, totalling to a sum of Rs. 4,44,240/-, shall be paid by the petitioner, hence, the Respondent authorities be directed not to take any further action. It is submitted that the petitioner is

The learned counsel for the respondentState has submitted that in case, the petitioner is ready to deposit the amount quantified by the impugned order dated 10.1.2017, the State Authorities shall not pursue the matter any further.

Having regard to the facts and circumstances of the case and considering the genuine and valid offer made by the learned counsel for the petitioner as also in the interest of justice and considering the fact that the petitioner is a law abiding citizen, who is ready to pay the deficit stamp duty, I deem it fit and appropriate to direct the petitioner to deposit the total amount quantified in the impugned order dated 10.1.2017 i.e. a sum of Rs. 4,44,240/-, within a period of six weeks from today, pursuant whereof, the respondents shall be debarred

Patna High Court CWJC No.7166 of 2017(10) dt.21-09-2022 3/3 from either recovering any further amount or taking any coercive action against the petitioner herein.

The writ petition stands disposed off on the aforesaid terms.
