JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rani Talab P.S. Case No. 70 of 2019 registered for the offences punishable under Sections 341, 323, 498A and 504/34 of the Indian Penal Code.

As per FIR there is allegation against the petitioner and his father that they demanded motorcycle from the informant and for that they tried to kill her by strangulation. Submission of learned counsel for the petitioner is that petitioner, who happens to be husband, has falsely been implicated in this case and there is no injury report available on the record and he is still ready to keep her with dignity and care which he has stated in the petition on oath.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender by 14.10.2019 and on surrender he shall be released on provisional bail for a period of four months by the court below to its own satisfaction and court below shall issue notice to opposite party No.2 and once she appears in the case and wants to reside with the petitioner, petitioner has to keep her with dignity and care and once the court is satisfied with their conduct, specially the conduct of the petitioner, the court below shall confirm the bail bonds of the petitioner, otherwise the court is free to pass any other order(s) as it may deem fit and proper, including cancellation of bail bonds of the petitioner.
