The petitioner is languishing in custody in a case registered for the offences punishable under Sections 498(A), 304(B), 201/34 of the Indian Penal Code.
The accusation is of killing the sister of the informant for non-fulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is husband of the deceased. There is general and omnibus allegation
Patna High Court CR. MISC. No.74806 of 2022(9) dt.07-08-2023 2/3 against the petitioner. In fact the sister of the informant was mentally ill which was not disclosed before marriage. The victim left the house and became traceless for which an informatory petition was filed before the Sub-Divisional Magistrate, Siwan. The independent witnesses have also corroborated this fact that victim was in habit to leave the house and fled away due to her mental status. It is further submitted that neither dead body of the victim was recovered nor there is any evidence about cremation of her dead body. The petitioner is languishing in custody since 22.08.2020. Learned APP appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner and submitted that petitioner is husband of the victim and the victim is still traceless.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
