JUSTICE ANIL KUMAR SINHA ORAL ORDER 04-11-2019 The petitioner apprehends his arrest in connection with Jakkanpur P. S. Case No. 181 of 2016 registered under Sections 147,148,149,323,337,353,427 and 504 of the Indian Penal Code. Allegation against the petitioner is that petitioner along with 32 named accused persons and 150 unknown persons put a blockade upon the road and damaged the vehicle of passersby. It has further been alleged that the accused persons assaulted the police party and caused hindrance in performance of official duty of the Government servant.

Learned counsel appearing on behalf of the petitioner submits that allegation against the petitioner and other accused persons are general and omnibus in nature and similarly situated co-accused persons have been granted bail by a co-ordinate Bench of this Court in Cr.Misc. No. 42030 of 2019.

No.65261 of 2019(2) dt.04-11-2019 2/2 Having regard to the submissions made by the parties and taking into consideration the fact that similarly situated other co-accused persons have been granted bail by a co-ordinate Bench of this Court, I am inclined to grant anticipatory bail to the petitioner.

Let the petitioner, above-named, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sub Judge-I-cum-ACJM, Patna in connection with Jakkanpur (Patna) P.S.Case No. 181 of 2016; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
