JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-10-2019 Petitioners seek bail in anticipation of their arrest in connection with Ghanshyampur P.S. Case No. 111 of 2019 registered for the offence punishable under Sections 302/34 of the Indian Penal Code.

As per FIR there is allegation against the petitioners that they along with others assaulted the deceased, causing her death.

Submission of learned counsel for the petitioners is that there is no eye-witness to the occurrence and the person, who informed the informant about the occurrence, has not been examined during investigation.

Heard learned APP, who has opposed the prayer for

Patna High Court CR. MISC. No.61061 of 2019(3) dt.17-10-2019 2/2 anticipatory bail on the ground that death caused due to strangulation and petitioners and one more person assaulted the deceased.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the petitioners. They may surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

This application is, accordingly, dismissed.
