JUSTICE SHIVAJI PANDEY ORAL ORDER 28-08-2017 Heard learned counsel for the petitioners and learned counsel for the State as also counsel for the Informant. In this case, the petitioners are apprehending their arrest in connection with Mashrak P.S. Case No. 76 of 2017 registered for offences under sections 304(B)/201/34 of the Indian Penal Code and 3/4 D.P. Act, 1961.
The marriage of the deceased Pinki Devi was organized with one Piysh Giri in the year 2013. An allegation has been made of demand of dowry and ultimately she was killed. Learned counsel for the petitioners has drawn attention of this Court towards paragraph nos. 45, 46, 47, 48 and 49 of the Case Diary wherein the police has recorded the statement
Patna High Court Cr.Misc. No.23448 of 2017 (6) dt.28-08-2017 of independent witnesses. As per petitioners, they have stated before the police that the deceased Pinki Devi was not murdered but, she was suffering from disease and there was an attack of B.P. due to which she fell down, she was brought to the Trauma Center and ultimately she died.
Looking to the entire facts and circumstances of the case, let the petitioners, namely, Ajit Giri, Krishna Kumar Giri @ Krishna Giri and Gyanti Devi, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-8, Saran, Chapra in connection with Mashrak P.S. Case No. 76 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been cancelled.
