2. The present application has been filed for quashing the FIR of NTPC P.S. Case No.31 of 2022 registered under Sections 409, 420 of the Indian Penal Code pending in the Court of Judicial Magistrate, 1st Class, Barh, Patna.

3. Learned counsel for the petitioner submits that the F.I.R. may be quashed on the basis of defence materials which is not permissible in law.

4. In view of the ration laid down by the Hon'ble Supreme Court in the case of State of Bihar Vs. P.P. Sharma,
