2. In view of the fact that cognizance has already been taken after submission of charge-sheet, the present application has become infructuous as it cannot be said that a prima facie case has not been found under the provisions of SC/ST Act.
3. However, taking in view that appellant no.1 is aged about 85 years, the learned counsel for the appellants seeks permission to withdraw the present application. Permission is accorded.

4. Accordingly, this application is dismissed as withdrawn. In case, the appellants surrender before the learned Court below within a period of four weeks from today and seek regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
