On 11.05.2016, a modification application vide Cr. Misc. No. 20148 of 2016 was filed on behalf of the petitioner for modification of the order dated 09.03.2016 passed in Cr. Misc. No.58564 of 2015, seeking further extension of four weeks time to surrender in the court below and deposit an amount i.e. Rs. 25, 000/-, which was allowed by this court and directed the petitioner to deposit the same in the court below within four weeks but the petitioner failed to do so.

This is the second modification application filed on behalf of the petitioner for further modification of the order dated 11.05.2016 passed in Cr. Misc. No.20148 of 2016. It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.23943 of 2017 (2) dt.17-05-2017 2/2 due to some unavoidable reason the petitioner failed to deposit the money amounting to Rs. 25,000/- in the court below and therefore, he could not surrender and furnish bail bond in the court below well within time. It is further prayed on behalf of learned counsel for the petitioner that time of surrender may be extended so that the petitioner could deposit the money and surrender in the court below and furnish bail bond.

Considering the submissions made on behalf of learned counsel for the petitioner and the grounds mentioned in the modification application, the period of surrender of the petitioner in the court below is extended for a further period of three weeks from the date of receipt/production of copy of the order. The order dated 11.05.2016 passed in Cr. Misc. No. 20148 of 2016, is modified to the extent as indicated above.

The modification application is, accordingly, disposed of (Sudhir Singh, J) Amit/- U T
