JUSTICE VINOD KUMAR SINHA ORAL ORDER 31-01-2020 Petitioner seeks bail in connection with Ghoshwari P.S. Case No. 32 of 2019, registered for the offences punishable under Sections 302, 201 and 34 of the Indian Penal Code. Dead body of a person was recovered from inside Hume pipe and later on he was identified and FIR was lodged against unknown and petitioner happens to be aunt of the deceased.

Submission of learned counsel for the petitioner is that confessional statement of co-accused disclosed another story that the deceased had taken some amount from the coaccused and for that some altercation took place in which they have strangulated the deceased and name of petitioner does not transpire in the confessional statement and she is in custody for more than seven months, charge sheet has been submitted, as

Heard learned APP and learned counsel for the informant, who has opposed the prayer for bail. In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri K.P. Arya, Judicial Magistrate, 1st Class, Barh, Patna, in connection with Ghoshwari P.S. Case No. 32 of 2019, subject to the condition that she has to co-operate in disposal of trial and appear in court as and when required.
