Petitioners are apprehending their arrest in connection with Sidhwalia P.S.Case no.130 of 2019 , registered for offences punishable under Sections 498(A), 341, 323, 325, 324, 307, 34 of the Indian Penal Code and Sections 3⁄4 of the D.P.Act. As per FIR, petitioners happen to be Bhaisurj of the informant and the allegation is of demand of dowry from the informant and ousting her from the house.

Submission of the learned counsel for the petitioners is that they are residing separately from the husband of the informant and partition has already been made between them

Patna High Court CR. MISC. No.67027 of 2019(3) dt.23-10-2019 2/2 and they have been falsely implicated in this case. They have no objection if the O.P.no.2 resides with her husband in her house. Heard learned A.P.P. and the learned counsel for the informant, who has opposed the prayer for bail.. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or2019 surrender before the learned court below, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM VI, District Gopalganj in connection with Sidhwalia P.S.Case No.130/19 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
