The petitioner is apprehending arrest in connection with Desari P.S. Case No. 26 of 2018 for the offence under Sections 399, 402 of the Indian Penal Code and Sections 25 (1-b) a and 26/35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submit that similarly circumstanced other co-accused namely Rahul Kumar has already been granted anticipatory bail by co-ordinate Bench of this Court in Cr. Misc. No. 24736 of 2018 vide order dated 30.04.2018.

Considering the aforesaid fact that similarly circumstanced other co-accused has already been granted

Patna High Court Cr.Misc. No.34699 of 2018(5) dt.10-12-2018 2/2 anticipatory bail and this petitioner has no criminal antecedent, let the petitioner above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 2nd, Hajipur, Vaishali in connection with Desari P.S. Case No. 26 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C.
