The petitioner apprehends his arrest in Goreyakothi P.S. Case No.118 of 2019, registered under Sections 353 and 34 of the Indian Penal Code as well as under Sections 30(a) and 45 of the Bihar Prohibition and Excise Act.

The informant alleged that during the course of patrolling, the informant spotted a person hiding behind a closed Gumti. The person was apprehended with liquor but Sushil Kumar Singh, the petitioner, who was a candidate of Mukhiya, and other villagers assaulted the police personnel and got the apprehended accused, Bablu freed from the custody of the police.

Learned counsel for the petitioner submits that the

No.68080 of 2019(2) dt.05-11-2019 2/2 petitioner was a candidate of Mukhiya and that is why at the instance of his enemy he has also been implicated in this case but the informant has got no enmity with the petitioner and the informant made allegation that it was the petitioner and his men who assaulted the informant and others and got the apprehended accused freed from the custody of the police. Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
