02. In the present case, the petitioner seeks bail in connection with Jamui P.S. Case No. 192 of 2025 registered for the alleged offences under Sections 126(2), 115(2), 352, 351(2), 109(1) and 3(5) of B.N.S. and Section 27 of the Arms Act.

03. As per prosecution case, in the background of earlier dispute, the petitioner shot at the informant in his mouth and thereafter took him to the hospital.

04. Learned senior counsel for the petitioner submits that the petitioner has been falsely implicated in this case and the allegation gets falsified from the contents of the FIR. If there was any intention to cause death of the informant, there was no

The occurrence took place on 25.03.2025 and the police has been informed only on 01.04.2025 and in between the informant did not inform the police about the occurrence. The petitioner has extended loan to the informant and in order to grab that loan, the informant has falsely implicated the petitioner. The informant somehow received a firearm injury and the petitioner without thinking anything took him to hospital. The petitioner provided all kinds of assistance to the informant and his family members while the informant has been undergoing treatment.

The police investigated the matter and exonerated all the family members against whom the informant has levelled allegations as they were not even found present at the place of occurrence. The petitioner was also not present at the place of occurrence. The niece of the petitioner has given application to the investigating officer for proper investigation in the matter. The petitioner is in custody since 18.05.2025 and charge sheet has been submitted. The petitioner is having clean antecedent.

05. Learned APP opposes the submission made on behalf of the petitioner. Learned APP submits that the specific against the petitioner is that he shot at informant in his mouth.

06. Having regard to the facts and circumstances and

No.65493 of 2025(4) dt.22-12-2025 3/3 submissions made on behalf of the parties and considering the doubtful nature of allegation and further considering the period of custody of the petitioner, his clean antecedent and submission of charge sheet, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui/concerned Court in connection with Jamui P.S. Case No. 192 of 2025, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions : (i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below. (iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
