The petitioner seeks bail in a case registered for the offence under Sections 342 and 376(2) of the Indian Penal Code and Section 4 of the POCSO Act.

Learned counsel appearing for the petitioner submits that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, no injury has been found on the external or internal body of the victim, which is evident from medical report, at Annexure-2. Moreover, the victim in her statement recorded under Section 164 Cr.P.C. has not disclosed anything against the petitioner. The petitioner is rotting in judicial custody since

Considering the facts and circumstances of the case, let the, above named, petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-1 -cum- Special Judge, POCSO Court, Patna in connection with Bihta P.S. Case No. 97 of 2019.
