The petitioner apprehends his arrest in connection with Complaint Case No.301 of 2021, registered for the offence punishable under Section 498A of the Indian Penal Code. The petitioner alongwith other co-accused persons are said to have tortured the complainant for non-fulfillment of demand of additional dowry.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is submitted that the petitioner has got no criminal antecedent as stated in paragraph-3 of the bail petition.
Patna High Court CR. MISC. No.65916 of 2022(3) dt.10-04-2023 2/2 It is further submitted that the matter has already been compromised between the parties. Learned counsel for the petitioner submits that he has filed the said compromise petition by way of supplementary affidavit.
Considering the fact that the matter has already been compromised between the parties, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st, Jhanjharpur, District Madhubani in connection with Complaint Case No.301 of 2021, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
