The petitioners apprehend their arrest in connection with Complaint Case No. 574 of 2018, registered under Sections 420, 406, 323, 341, 379, 504 and 506/34 of the Indian Penal Code.

The accusation is that the parents of the complainant Pratima Kumari died in the year 2000. Thereafter, she started to live at her maternal uncle's house. The petitioners being the aunt and uncle asked her to give Rs. Three lakhs for her marriage on execution of the sale deed regarding land of Plot No. 300, Khata No. 45, which was in her share. Thereafter,

No.60503 of 2019(2) dt.24-09-2019 2/2 she was taken at registry office on 05.02.2018 and on the instruction of the petitioners, she executed sale deed in respect of the said land. Later on, she came to know that on the pretext of executing the sale deed in respect to land of Plot No. 300, both petitioners under conspiracy got executed the Sale deed of the land of her whole share, later on, she was removed from house on 12.09.2018.

Learned counsel for the petitioners submits that after execution of the sale deed by the complainant in favour of the petitioners on 05.02.2018, at the instigation of her maternal uncle, she lodged the present complaint Case with false allegation. The petitioners have no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Serghati at Gaya in connection with Compliant Case No. 574 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
