2. The petitioner apprehends his arrest in connection with Sahiyara P.S. Case No.06 of 2023, registered for the offences punishable under Sections 363, 366/34 of the Indian Penal Code.

3. As per allegation, the petitioner along with other coaccused persons kidnapped the minor daughter of the informant while she had gone to purchase some articles from a nearby shop.

4. Learned counsel for the petitioner has submitted that there is love and affection between the parties and the statement of the victim recorded under Section 164 of the CrPC shows itself that no misdeed was committed by the petitioner against the victim.

5. On the other hand, learned counsel for the informant

Patna High Court CR. MISC. No.69646 of 2023(2) dt.01-11-2023 2/2 has opposed the prayer for bail and has submitted that the victim was a minor girl.

6. Considering the above-mentioned facts and circumstances as well as the statement of the victim recorded under Section 164 of the CrPC, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge VIcum-Special Judge, POCSO, Sitamarhi in connection with Sahiyara P.S. Case No.06 of 2023, subject to the conditions as laid down under Section 438(2) CrPC.
