The petitioner apprehends his arrest in connection with Khanpur P.S. Case No.82 of 2019 registered under Sections 341, 323, 324, 307 and 337/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Samastipur.

The accusation is that when the informant went to urinate at the corner of the road, at that time, this petitioner caused cut injury through spade at the head of the informant, whereas the other F.I.R. named accused after dashing the informant on the ground started to cause assault at his chest, due to which the informant became unconscious raising alarm.

Patna High Court CR. MISC. No.61342 of 2019(2) dt.14-10-2019 2/2 Learned counsel appearing on behalf of the petitioner submits that while the alleged occurrence is said to be of 21.06.2019 but the present F.I.R. was lodged on 24.06.2019, after three days of the alleged occurrence.

Having considered the facts and the circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer of the petitioner for grant of anticipatory bail stands rejected. However, the petitioner is directed to surrender before the trial court within four weeks from today and pray for regular bail, which shall be considered by the trial court in accordance with law without being prejudiced by the order of this Court.
