Petitioner apprehends arrest in connection with Araria (Bairgachhi) P.S. Case No. 505 of 2020 registered for the offence under section 307 and other allied sections of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has not committed any offence as alleged in the first information report and has been falsely implicated in this case.a Title suit is also pending between the parties. Petitioner has no criminal antecedent.
Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is direct allegation of assault against this petitioner which is supported by the injuries
Patna High Court CR. MISC. No.67866 of 2022(2) dt.24-01-2023 2/2 sustained. Petitioner, therefore, does not deserve to be granted the privilege of bail.
Considering the nature of allegations levelled and the submissions advanced on behalf of the parties, this Court is not inclined to grant the privilege of anticipatory bail to the petitioner. His prayer for bail is, accordingly, rejected. mcv/- (Arvind Srivastava, J) U T
