2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 303(2), 317(2), 3(5) of the Bharatiya Nyaya Sanhita, Sections 4(1)(A)/21 of the Mines and Minerals (Development And Regulation) Act, 1957, Rules 11, 18, 39 of the Bihar Minerals (Prevention of Illegal Mining, Transportation and Storage) Rules, 2003 and Rule 56 of Bihar Minerals Rule, 2021.

3. Allegation against the F.I.R. named accused persons is of illegal mining and storage of sand from the bank of Batane river.

4. Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.65062 of 2025(2) dt.17-09-2025 2/2 petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R. and named accused Satyam Chauhan has already been granted anticipatory bail by coordinate Bench of this Hon'ble Court vide order dated 11.08.2025 passed in Cr. Misc. No. 50676 of 2025.

5. Learned A.P.P. for the State as well as learned counsel for the informant vehemently opposed the bail application.

Considering the aforesaid facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Muffasil P. S. Case No. 124 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) Navya/- U T
