The petitioner is apprehending his arrest in connection with Goraul P.S.Case No.57 of 2018 registered for offences punishable under Sections 363, 366 (A)/34 of the Indian Penal Code. Allegation against the petitioner is of kidnapping the minor daughter of the informant.
Submission of the learned counsel for the petitioner is that he has been made accused only on the basis of suspicion and there is nothing against him.
Heard learned A.P.P. , who has opposed the prayer for bail stating that in para nos. 8 and 9, the name of the petitioner also transpires and the girl is still traceless..
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.39329 of 2018 (4) dt.06-09-2018 2/2 circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
