Petitioner apprehends his arrest in connection with Barsoi P.S.Case No. 287 of 2017 registered for the offences punishable under Section 392 of the Indian Penal Code.
Allegation as per FIR is that two accused persons came on a motorcycle and snatched the bag of the informant containing Rs.1.5 lakhs.
Submission of learned counsel for the petitioner is that petitioner is not named in the FIR and later on his name transpires in CCTV footage and identification in CCTV footage is unbelievable as petitioner wore helmet and moreover there is no recovery from the possession of the petitioner. Heard learned APP also.
Patna High Court Cr.Misc. No.41497 of 2018 (3) dt.31-07-2018 2/2 Having heard both sides and in view of serious nature of allegation as well as identification in CCTV footage, I am not inclined to grant privilege of anticipatory bail to the petitioner. Hence, this application is dismissed.
