JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 10-01-2024 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 354(D), 509, 504, 506 of the Indian Penal Code, Sections 66E, 67B of the I.T. Act and Sections 10, 12 of the POCSO Act.

It is alleged against the petitioner that he uploaded the obscene pictures and videos of the informant on social media platform and also threatened her in different ways through mobile.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.69934 of 2023(3) dt.10-01-2024 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The petitioner is the distant relative of the informant, as such, father of the informant wanted to marry the informant with the petitioner but when the petitioner's family denied the proposal of marriage of the petitioner with the informant, hence, this false case has been registered against the petitioner. The petitioner has never uploaded any photograph or vide of the informant. The petitioner is languishing in custody since 06.08.2023. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount
