2. The petitioner has preferred this application for grant of regular bail in connection with Andhrathari P.S. Case No. 47 of 2024 dated 18.03.2024 registered for the offences punishable under Section 379 of the Indian Penal Code.

3. As per the prosecution case, the informant alleged that on 17.03.2024, the motorcycle of the informant was stolen which was parked at the door of one Paltan Jha.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is not named in the FIR. The name of the petitioner was transpired in this case in the confessional

Patna High Court CR. MISC. No.65102 of 2025(2) dt.13-10-2025 2/3 statement of the co-accused, Amit Kumar Mandal. No TIP has been conducted by the prosecution. The charge-sheet has been submitted against the petitioner. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged offence. The petitioner has five criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 19.05.2025.

Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner and submitted that as per para-83 of the case diary, the co-accused Amit Kumar Mandal in his confessional statement has stated that he along with the petitioner had stolen the said motorcycle from the village Thadhi.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jhanjharpur, Madhubani in connection with Andhrathari P.S. Case No. 47 of 2024, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date,

Patna High Court CR. MISC. No.65102 of 2025(2) dt.13-10-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
