Petitioner has filed this application for making payment of earned leave of 64 days along with penal interest. Though the writ application was filed in the year 2017, but till date no counter affidavit has been filed on behalf of the State. In view of the nature of the grievance of the petitioner, the writ application is disposed of with a direction to the respondent no.2, the District Magistrate, Khagaria to consider the grievance of the petitioner. The petitioner is directed to file representation before the respondent no.2 within a period of four weeks from the date of receipt/production of a copy of this order. If such representation is filed within the
Patna High Court CWJC No.7429 of 2017(3) dt.07-05-2019 2/2 stipulated period, the respondent no.2, is directed to dispose of the representation by a speaking order strictly in accordance with law.
Needless to say, if any admissible dues is found due to the petitioner, the same would be paid within two months thereafter.
With the aforesaid observation, this writ application is disposed of.
