JUSTICE BIRENDRA KUMAR ORAL ORDER 25-08-2018 This is an appeal under Section 14(A) (2) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the refusal of prayer for anticipatory bail vide order dated 06.10.2017 passed by the learned Additional Sessions Judge-1st, Supaul in A.B.P. No.818 of 2017, arising out of Triveniganj Police Station Case No.217 of 2016 registered under Sections 341, 323, 379, 504, 506, 307/34 of the Indian Penal Code and Section 3(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act. Prayer is for time on the personal inability of the learned counsel for the appellants.
Patna High Court CR. APP (SJ) No.2570 of 2018(3) dt.25-08-2018 2/2 The office report reveals that this appeal has been preferred after expiry of 180 days from the date of impugned order. Hence, this appeal is not maintainable in view of the bar under proviso to Section 14 A(3) of the Scheduled Castes & Scheduled Tribes Act.
