JUSTICE BIRENDRA KUMAR ORAL ORDER 01-07-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420/467/468/471/34 of the Indian Penal Code.
The petitioners are Army-men. They are not named in the F.I.R. During investigation one co-accused confessed before the police that the petitioners were indulged in allowing backdoor entry in Army.
Submission is that except confession of the coaccused there is no other material to substantiate the allegation against the petitioners.
Patna High Court Cr.Misc. No.24101 of 2017 (2) dt.01-07-2017 2/2 Considering the nature of allegation and the fact that the petitioners are Army man, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur/Successor Court in connection with Sahpur Police Station Case No.19 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. With further condition that petitioners shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioners in this case.
