Petitioner apprehends his arrest in connection with Tekari P.S.Case No. 264 of 2017 registered for the offences punishable under Sections 147, 148, 341, 323, 307, 447, 504 and 506 of the Indian Penal Code.
Allegation against the petitioner is of assault by rod on the head of informant.
Submission of learned counsel for the petitioner is that there is land dispute between the parties and there is case and counter case and though opinion on the injury was kept reserved but due to land dispute the petitioner has falsely been implicated. Heard learned APP also.
Having heard both sides and in the facts and
Patna High Court Cr.Misc. No.44091 of 2018 (4) dt.20-08-2018 2/2 circumstances, as stated above, let the petitioner, named above, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya, in connection with Tekari P.S.Case No. 264 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
