The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 307, 427, 353 and 188 of the Indian Penal Code. As per prosecution case, some miscreants quarreled with each other in two group in connection with the repairing of motorcycle and its charges. They have committed mischief and damaged the shops and auto rickshaw. During occurrence some local persons and four police personnels became injured and thereafter about 100-150 persons fled away.
Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in the present case. He submits that similarly situated co-accused has
Patna High Court CR. MISC. No.66480 of 2022( 2) dt.25-02-2023 2/2 already been grated anticipatory bail by the Co-ordinate Bench of this Court by order dated 08.08.2022 in Cr. Misc. No. 2662 of 2022. He further submits that the petitioner has no criminal antecedent as mentioned in para-3 of the bail application. Learned APP for the State opposes the prayer for bail. Considering the facts and circumstances of the case, let the above named petitioner in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Manigachi P.S. Case No. 31 of 2020, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Anjani Kumar Sharan, J) Arish/- U T
