1. Heard learned counsel for the parties.
2. The petitioner has preferred this application for grant of regular bail in connection with Beldour P.S. Case no. 264 of 2022 registered under sections 307, 353, 504 and 34 of the Indian Penal Code and sections 25(1-B)(a), 26, 27 and 35 of the Arms Act.
3. As per the prosecution case, on information having been received about the petitioner being present at the place of occurrence along with other accused and planning to give affect an occurrence, it is stated that a raid was conducted and the petitioner was caught. From his possession two country made pistols with live cartridge were recovered besides other articles as mentioned in the FIR.
4. It is submitted by learned counsel for the
Patna High Court CR. MISC. No.71547 of 2023(2) dt.07-11-2023 2/2 petitioner that the petitioner has been falsely implicated in the case because of his antecedents. No incriminating article has been recovered from his possession. He is in custody since 1.12.2022 and chargesheet has been submitted in the case.
5. Heard learned A.P.P. for the State.
6. Having heard learned counsel for the parties and taking into consideration the allegations in the FIR, the petitioner having remained in custody for 11 months since 1.12.2022 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Beldour P.S. Case no. 264 of 2022 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate- 1st Class, Khagaria.
