The petitioner apprehends his arrest in connection with Raniganj P.S. Case No. 308 of 2017, registered under Sections 341, 323, 379, 354 (B), 504/34 of the Indian Penal Code.

The allegation against the petitioner is that petitioner along with other co-accused person assaulted the informant and tried to outrage her modesty.

Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case inasmuch as both the parties are co-villager and there is land dispute on trivial issue that buffalo of the petitioner entered into the field of the informant. Patna High Court CR. MISC. No.62030 of 2019(2) dt.17-10-2019 2/2 further submits that a counter case has been lodged by the wife of the petitioner having Raniganj P.S. Case No. 312 of 2017. Learned counsel for the petitioner further submits that no serious injuries has been caused to the informant. After having heard learned counsel for the parties and taking into consideration the fact that both the parties are covillager and there is case and counter case between them, I am inclined to grant anticipatory bail to the petitioner. This application is, accordingly, allowed.

Let the petitioner, abovenamed, in the event of arrest or surrender before the Court below within a period of four weeks from today, be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Araria,in connection with Raniganj P.S. Case No. 308 of 2017; subject to the condition as laid down hereinabove and under Section 438 (2) of the Code of Criminal Procedure. (Anil Kumar Sinha, J) T.Kr./- U T
