2. The petitioner has prayed for bail in connection with Muffasil P.S. Case No. 99 of 2022 registered for the offence punishable under Sections 30(a) (b), 32 and 41(1) of the Bihar Prohibition and Excise Act.
3. The case of the prosecution is that, 05 liters of country-made liquor and 22,000 liters of semi prepared liquor was recovered from bamboo orchard.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also submits that nothing has been recovered from the
Patna High Court CR. MISC. No.65039 of 2025(2) dt.23-09-2025 2/2 possession of this petitioner rather the recovery has been made from bamboo orchard, which is an open place. He further submits that the petitioner is languishing in judicial custody since 03.07.2025.
5. The application for bail is opposed by learned APP for the State and submits that the petitioner is having criminal antecedent of one case.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Excise Court No. 1, Motihari, East Champaran in connection with Muffasil P.S. Case No. 99 of 2022.
