2. The petitioner seeks bail in connection with Jagdishpur P.S. Case No. 23 of 2025 registered for the offences punishable under Sections 64(2)(f)(j) of the B.N.S. and Section 4/6 of POCSO Act.

3. As per the prosecution case, the informant alleged that Raj Kumar (petitioner), her brother-in-law had established physical relationship with her leading to her pregnancy and on 06.02.2025, she delivered a female child at Bettiah hospital.

4. From the statement of the victim girl recorded under Section 183 of B.N.S.S., it appears to be a case of

Patna High Court CR. MISC. No.66341 of 2025(2) dt.24-09-2025 2/2 consensual sex.

5. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Learned counsel further submits that petitioner has clean antecedent and he is in custody since 06.02.2025.

6. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

7. Considering the facts and circumstances of the case, this application for regular bail is allowed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge VIth-cumthe Exclusive Special Judge, Rape & POCSO Act, West Champaran at Bettiah/concerned Court below in connection with Jagdishpur P.S. Case No. 23 of 2025.
