Mr Md Aslam Ansari, APP ====================================================== CORAM: HONOURABLE MR JUSTICE ARVIND SINGH CHANDEL ORAL ORDER 01-08-2024 This revision petition has been preferred by the petitioner (juvenile) being aggrieved by the order dated 16.08.2023 passed by the learned Additional Sessions Judge I -cum- Children Court, Saran at Chapra in Criminal Juvenile Appeal No 10 of 2023, Registration No 10 of 2023 affirming the order dated 08.06.2023 passed by the JJB, Saran at Chapra in JJB No 52 of 2023 arising out of Bhagwan Bazar PS Case No 12 of 2023 instituted for the offence punishable under Sections 302, 120B, 341 of IPC.
In this case, the petitioner was in Observation Home, Chapra in connection with Chapra Town PS Case No 469 of 2021 registered for the offence punishable under Sections 302/34 of IPC. Allegedly, on 14.01.2023, he long with other accused persons (juvenile), who were in Observation Home for intention to flee from the Observation Home, assaulted the security guard Chandra Bhushan Singh. Patna High Court CR. REV. No.660 of 2023(6) dt.01-08-2024 2/2 injuries and subsequently died. On the basis of information given by the Superintendent of Observation Home, FIR has been registered and the petitioner was taken in custody. Initially, the petitioner preferred an application for grant of bail before the learned JJB which has been rejected by the JJB vide its order dated 08.06.2023. The appeal has been preferred by the petitioner being Criminal Juvenile Appeal No 10 of 2023 which has also been rejected by the learned appellate Court vide the impugned order dated 16.08.2023. Hence, this revision petition.
Heard learned counsel for the petitioner. Also heard learned State Counsel. Perused the impugned orders as well as documents annexed with the petition especially social investigation report.
Perusal of social investigation report clearly shows that the petitioner was in the company of anti social elements and he is indulged in extortion.
Considering the above facts, this application is rejected.
