2. Petitioner apprehends arrest in case registered for the offences punishable under Sections 8(c), 21(b), 29 of the Narcotic Drugs and Psychotropic Substances Act, 1985.

3. As per prosecution case, 57.53 grams smack was recovered from the house of co-accused Upendra Chaudhary @ Fatta and 3.97 grams smack was recovered from the house of co-accused Daulti Devi.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. No incriminating material has been recovered from conscious possession of the petitioner and she is no way connected with the aforesaid recovery. Name of petitioner transpired during course of investigation on confessional statement of co-accused.

5. Learned A.P.P. for the State vehemently opposed the bail application and submitted that petitioner has got one criminal antecedent of similar nature.

6. Considering the nature of accusation and criminal antecedent, prayer for anticipatory bail of the petitioner is refused.
