Heard learned counsel for the petitioner, learned APP for the State and learned counsel for the informant.

The petitioner is apprehending his arrest in a case registered under Sections 498A, 379, 504/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act.

Allegation against the petitioner is of committing torture upon the victim due to non-fulfilment of demand of dowry. It has been submitted that the matter has been settled between the parties. Paragraph Nos.3, 5 and 6 of the joint affidavit is as follows :

"3. That the case was listed for admission before Hon'ble Mr. Justice Sudhir Singh and as per direction

Patna High Court Cr.Misc. No.47921 of 2018(4) dt.17-09-2018 2/2 of Hon'ble Court dated 6.8.2018 both Ratish Raman & Tripti Kumari appeared before Hon'ble Court in person on 8.8.2018 and Hon'ble Court asked the petitioner Ratish Raman whether he wants to keep his wife and also asked Tripti Kumari that she wants to live with her husband and both were answered that they are ready to live together and upon their consent and undertaking both are living peacefully.

5. That we are living together and lead conjugal life peacefully.

6. That both will live together peacefully and with withdraw each cases filed against each other. Considering that the matter has been settled between the parties, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Smt. Priya Shekhar, J.M. 1st class, Patna in connection with Mahila P.S. case No.44 of 2018, G.R. No.2605 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) Narendra/- U
