JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-04-2024 The present writ petition has been filed seeking the following relief:- "1.That by this application, the Petitioner is invoking the writ jurisdiction of this Hon'ble Court in the nature of Writ of Mandamus for directing the Respondents to grant 3rd MACP in pay level-12 with grade pay of Rs. 7600 w.e.f. 11.01.2018 even no departmental proceeding or criminal case was pending against the Petitioner. However, the petitioner has retired from service on 28.02.2022 as Assistant Engineer, Road Construction Department, Bihar, Patna."

At the outset, the learned counsel for the

Patna High Court CWJC No.15256 of 2023(2) dt.08-04-2024 2/2 petitioner fairly submits that during the pendency of the present writ petition, the petitioner has already been granted the benefits of third MACP, hence it is submitted that the present writ petition be disposed off.
