2. The petitioner apprehends his arrest in connection with Chakand P.S. Case No. 177 of 2023, registered for the offences punishable under Sections 147, 149, 341, 323, 332, 337, 338, 353, 354, 379, 411, 413, 504 of the Indian Penal Code and 21MM (D&R) Act & 56 (CPIMTS) Act.

3. As per allegation, on 30.05.2023, after getting information, a raid was conducted by the police along with other police personnel at Village- Murkatta, Near N.H.-83 More. There, he found five tractors loaded with illegally mined sand. On seeing the police personnel, all the accused persons tried to flee away. One driver was apprehended by the police party. Petitioner is the owner of the seized tractor.

4. The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and the entire fine amount has been deposited by him and the tractor has been released in his favour.

5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M-X, Gaya in connection with Chakand P.S. Case No. 177 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C.
