2. This is the second attempt of the petitioner for grant of regular bail in connection with NDPS Case No. 42 of 2023 arising out of Raxaul P.S. Case No. 227 of 2023 registered for the offence under Section 20(b)(ii)(c)/23(c)/25 of the NDPS Act.

3. As per the prosecution case, the recovery is of 1.150 kilograms of Charas.

4. In the trial, the police has tried to produce the witnesses but due to unavoidable circumstances, the evidence of the witnesses cannot be recorded and the next date in the trial is fixed on 19.04.2025.

5. Learned A.P.P. has vehemently opposed the prayer

Patna High Court CR. MISC. No.75755 of 2024(6) dt.18-04-2025 2/2 for bail and has assured this Court that in the trial, the witnesses shall be produced by the police.

6. Considering the huge quantity of recovery from the petitioner, this application is dismissed.

7. The trial is directed to be expedited.

8. The Superintendent of Police, East Champaran will ensure the attendance of the witnesses in the trial.

9. Let a copy of this order be communicated to the Superintendent of Police, East Champaran through FAX for its compliance.
