2. The petitioner has prayed for bail in connection with Goshwari P.S. Case No. 167 of 2024 registered for the offence punishable under Sections 126(2), 115(2), 117(2), 109, 352, 3(5) of the B.N.S., 2023.

3. The case of the prosecution is that the petitioner, along with others, has assaulted the informant, due to which his two fingers were fractured. It is further alleged that when Pradeep Kumar and Dhananjay Kumar came to rescue, they were also being assaulted by lathi, danda and iron rod pipes.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. He also

Patna High Court CR. MISC. No.67240 of 2025(2) dt.17-09-2025 2/2 submits that from perusal of the FIR, it is clear that the nature of the allegation is general and omnibus. It has also been submitted that two accused persons having a similar nature of allegation have been granted bail by the learned Co-ordinate Bench of this Court in Cr. Misc. No. 51776 of 2025. The case of this petitioner stands on similar footing. He further submits that petitioner is languishing in judicial custody since 18.06.2025.

5. The application for bail is opposed by learned APP for the State and submits that the petitioner has criminal antecedent of two cases.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Barh (Patna) in connection with Goshwari P.S. Case No. 167 of 2024.
