Petitioners apprehend arrest in connection with Jogapatti (Nawalpur) P.S. Case No. 312 of 2022 registered for the offence under sections 420, 406 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that petitioners have already returned Rs. 14780 to the informant through Pay phone vide Annexure-3. It is further submitted that petitioners are returning the remaining amount of Rs. 20,000/- through cheque No. 051971 dated 01.02.2023 of Central Bank of India. Learned counsel has handed over the original cheque
Patna High Court CR. MISC. No.66320 of 2022(3) dt.02-02-2023 2/2 to the learned counsel for the informant. As such there is no due on the petitioners. Learned counsel has produced the photocopy of the cheque also. Let it be kept on record. Petitioners have no criminal antecedent.
Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioners, above named, are directed to be released on bail on furnishing personal bond to the satisfaction of Chief Judicial Magistrate, West Champaran in connection with Jogapatti (Nawalpur) P.S. Case No. 312 of 2022 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
