2. The petitioner has preferred this application for grant of regular bail in connection with Laukahi P.S. Case No. 210 of 2023 vide G.R. No. 561 of 2023 dated 01.08.2023. registered for the offence punishable under Sections 272, 273 and 414 read with 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 144 litres of illicit liquor was recovered from the two motorcycles and the petitioner was apprehended on the spot.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in

Patna High Court CR. MISC. No.67703 of 2023(2) dt.18-10-2023 2/2 this case. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 02.08.2023.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that petitioner is owner of one of the motorcycles.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Jhanjarpur, Madhubani in connection with Laukahi P.S. Case No. 210 of 2023 vide G.R. No. 561 of 2023.

7. The application stands allowed.
