2. Petitioners apprehend their arrest in a case registered for the offence punishable under sections 147, 406, 420, 504, 506 and 120B of the I.P.C.

3. As per prosecution story, the informant entered into an agreement on 03.02.2021 for sale of two Hyva Trucks in favour of one Ram Prasad Madiya and he paid Rs. 5,00,000/- in advance and agreed to pay rest Rs. 37,00,000/- on installments but after few installments, he stopped the payment. It is alleged that petitioners had signed as witnesses in the agreement.

4. It is submitted on behalf of the petitioners that

Patna High Court CR. MISC. No.69521 of 2025(2) dt.07-10-2025 2/2 as per complaint, petitioners are only witnesses of the agreement. No money was paid to these petitioners. It is a case of breach of agreement which is purely civil in nature. Petitioners claim clean antecedent.

5. Learned counsel for the State opposed the bail petition.

Considering the clean antecedent of these petitioners, they are only identifiers of the alleged agreement and other circumstances of the case, in the event of arrest or surrender within eight weeks from today, let the petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 1924 of 2023, subject to the conditions laid down under section 482(2) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS), 2023.
