2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 80, 238 and 3 (5) of the BNS, 2023.
3. The case of the prosecution is that Babita Kumar (deceased) was married to one Manjay Kumar and after marriage, she went to her matrimonial home. It is alleged that within 2-3 days of her marriage, the in-laws started demanding Rs. 2,00,000/- and a bike as dowry. It is further alleged that on 28.06.2025 she was killed and her dead body was concealed somewhere.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.66082 of 2025(3) dt.28-11-2025 2/2 connection with the present case. It is further submitted that the petitioner is brother-in-law of the deceased. The main thrust of allegation is against the husband of the deceased, who is already in custody. Moreover, the petitioner is languishing in judicial custody since 02.07.2025 having no criminal antecedent.
5. Learned APP appearing for the state has opposed the prayer of regular bail.
6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Madhuban P.S. Case No. 229 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate-1st Class, Motihari, East Champaran.
