1. The present petition has been filed for restoration of a writ petition, bearing C.W.J.C. No.11813 of 2008, to its original file, which has stood dismissed for non-prosecution, by an order dated 25.01.2017.

2. The learned counsel for the petitioner submits that now a different set of advocates are appearing in the present case and the earlier counsel, appearing in the present case, had not attended the case on the day when the same was called out for hearing, for reasons unknown to the petitioner, resulting in the aforesaid writ petition having stood dismissed for non-

Patna High Court MJC No.2808 of 2023(2) dt.11-01-2024 2/2 prosecution, thus, a sympathetic view be taken and the aforesaid writ petition be restored to its original file for which the petitioner is ready to comply with such conditions as may be deemed fit and proper to be imposed by this Court.

3. Having regard to the facts and circumstances of the case and considering the submissions made by the learned counsel for the petitioner, I deem it fit and proper to direct for restoration of the aforesaid writ petition, bearing C.W.J.C. No.11813 of 2008, to its original file subject to the petitioner depositing a sum of Rs.5,000/- with the Patna High Court Legal Services Committee, within a period of two weeks from today.

4. The present petition stands disposed off on the aforesaid terms.
