2. The petitioner apprehends his arrest in connection with Goriakothi P.S. Case No.57 of 2023 registered for the offences punishable under Section 394 of the Indian Penal Code.

3. The First Information Report discloses that while the informant was returning on bike one person riding on Apache motorcycle hit him on the leg due to which he fell down and he was also injured by assault with knife and his cash, credit card and debit card etc. were taken away.

4. It has been submitted by the learned counsel for the petitioner that the present case has been lodged against the four unknown persons riding on two motorcycles. The name of the

Patna High Court CR. MISC. No.69033 of 2024(6) dt.21-04-2025 2/3 petitioner has transpired in the present case on the confessional statement of one Simant Singh who has taken the name of this petitioner along with others and no other material has been collected during the course of investigation.

5. It has also been submitted that the petitioner has been residing at Delhi since 2022 and has been working as truck driver and he is in no way involved in the present case.

Learned APP for the State, however, opposes the prayer for anticipatory bail of the petitioner on the ground that the name of the petitioner has also transpired in this case and there are two criminal antecedents, one being of the same nature. In response to the same, learned counsel for the petitioner submits that the petitioner is on bail in both the cases.

7. Taking into consideration the abovementioned facts and circumstances of the case, I am inclined to extend the privilege of anticipatory bail to the petitioner. Let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-1st Class, Siwan in connection with Goriakothi P.S. Case No.57 of

(2) of the Cr.P.C. and subject to the further condition that:- (i) The petitioner shall cooperate in the investigation/trial.

(ii) The court below shall verify the criminal antecedent of the petitioner and in case it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner.
