====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 13-10-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners seek bail in connection with Bhagalpur Cyber P.S. Case No. 59 of 2025 dated 13.07.2025 registered for the offences punishable under Sections 316(2), 318(4), 111(2) of the B.N.S., 2023 and Sections 66C and 66D of the I.T. Act.

3. As per the prosecution case, the petitioners alongwith Saurav Kumar @ Golu used the Aadhar Card of the informant to commit forgery by opening accounts in different Banks, after verifying from the Bank, the informant came to

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is no specific allegation against the petitioners rather the same is against the co-accused Saurav Kumar @ Golu. The loan amount was not disbursed by the Bank and the account was under hold. The names of the petitioners have surfaced in the present case on the basis of the confessional statement of the co-accused Saurav Kumar @ Golu which has got no evidentiary value in the eyes of law. No incriminating article has been recovered from the possession of the petitioners. The petitioners are students in 'Sarvajanik Mahavidlaya', Banka. The petitioners have clean antecedent as stated in paragraph no. 3 of the bail petition. They are in custody in this case since 14.07.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners, above named, are directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of

Case No. 59 of 2025 with further condition:- (I) The petitioners are directed to remain physically present before the learned court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled.
